General commercial conditions

These general commercial conditions (hereinafter as GCC) adjust the relationship between the buyer and the seller in the field of sale of goods, mainly the Magazine Youth Time, between the company Youth Time S. R. O. (hereinafter as “seller”) and its business partners (hereinafter as “buyer”).

I. Basic provisions
These general commercial conditions (hereinafter as GCC) adjust the relationship between the buyer and the seller in the field of sale of goods between the company Youth Time S. R. O. and its business partners.By placing an order, the buyer confirms that he has been acquainted with these commercial conditions, which include the claims procedure rules, and the he agrees with them. The buyer has been sufficiently informed about the conditions prior to order and had time to acquaint himself with them.
The seller
The seller is Youth Time S. R. O., id.no. 24706710, having its registered seat at Národní 60/28, 110 00 Prague 1, written in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 167633.
Buyer
The buyer is the consumer or a businessman.
The consumer is a physical entity, which when concluding and observing a purchase contract with the seller does not act within his commercial or business activities or within execution of their performance.
The customer, when commencing commercial relationship, hands over his contact data necessary for problem-free handling of the order, or data, which he wants to have noted in purchase documents.
Legal relations of the buyer with the customer which are not adjusted by these GCC are subject to relevant provisions of Act no. 40/1964 Coll., Civil Code and Act no. 634/1992 Coll., on protection of customer, both as amended, as well as with relevant provisions.
Businessman is understood as:
a person written in the Commercial Register (mainly commercial companies), a person, who conducts business based on a trade license (tradesman written in the Trade Register), person, who does business base on another trade authorization in line with special regulations (this includes free professions such as advocacy etc.) and person who conducts agricultural production and is recorded according to special rules.
Legal relation of the seller and the buyer, who is a businessman, which are not adjusted by these GCC or by the contract between the seller and the buyer are subject to Act no. 513/1991 Coll., Commercial Code as amended, as well as by relevant provisions. Individual contract of the seller with the buyer surpasses commercial conditions.
The buyer is aware, that by purchasing the products, which are offered by the seller, no rights to use of registered trademarks, commercial names, company logos or patents of the seller or other companies, unless agreed otherwise by a special contract.

Purchase contract:
If the buyer is a customer, the proposal to conclude a contract is effected by sending the order by the buyer customer and a purchase contract is effected by confirming the order by the seller. Concluded contract (including an agreed price) may be changed or cancelled by an agreement of parties or based on legal reasons.
In the buyer is a businessman, the proposal to conclude a contract is effected by sending the order by the buyer businessman and a purchase contract is effected by confirming the delivery of binding agreement of the seller to the buyer regarding the consent with the proposal.
Relationships and possible disputes arising in relation with the contract will be settled exclusively in line with the laws of the Czech Republic and will be handled by the courts of the Czech Republic.
The contract is concluded in Czech language. Should there be a translation for the purpose of the buyer, then the Czech version prevails in respect to meaning of words and phrases.
The concluded contract is archived by the seller in order to ensure successful performance and is not accessible to third, uninvolved parties. Information on individual technical steps leading to contract signing are apparent from these commercial conditions, where this process described in detail. The buyer has the right, prior to sending the order, to check it and correct it if needed. These commercial conditions are depicted on the web pages of the e-shop http://youth-time.eu/.
Costs of communication equipment use (telephone, internet etc.) for ordering are on regular level, depending on telecommunications tariff that the buyer utilizes.

II. Safety and protection of information
The seller declares that all personal data is confidential and will be used only to perform the contract with the buyer and will not be published, provided to a third party etc., with the exception of situation relating to the distribution or payment regarding the ordered goods (providing name and delivery address). Personal data provided by the buyer to the seller for the purpose of fulfilling the order are collected, processed and kept in line with the valid laws of the Czech Republic, especially in line with Act no. 101/2000 Coll., on protection of personal data, as amended. The buyer provides his consent to collect and process this data for the purpose of completion of the subject of the purchase contract and that until his written notification of the contrary. By providing his e-mail address he provides consent with sending commercial reports via electronic mail. This consent may be withdrawn by the buyer at any time.

III. Accepting orders
Orders are accepted through an e-shop at the address http://youth-time.eu/ 24 hours 7 days a week

lV. Prices
All prices are published on the pages of the e-shop. Valid prices are those that are up to date.

V. Ordering
Buyer gets the goods for price valid at the time of placing the order. Prior to performing the order, the buyer has the right to acquaint himself with the total price incl. VAT and all other fees (PHE etc.). This price will be shown in the order as well as in the message confirming the acceptance of goods. Prior to placing the order, the buyer has the right to acquaint himself about the duration of validity of the offer and the price. If this concerns special goods on the order, or goods which are not on stock, the seller will confirm to the buyer by a telephone/e-mail the price and the delivery date. This price may be changed by the seller depending on the current situation on the market an on the development of the exchange rate of the Czech Crowns to other currencies. Should the buyer not agree with such change and does not confirm the order, then such order shall not be effected. If the buyer is a consumer, then he has to be acquainted with the fact that such goods are on order and that conclusion of the purchase contract with the parties will be effected only after the offer from the seller is confirmed.

The seller recommends the buyer to use the e-shop.

VI. Withdrawal from contract
Withdrawal by a buyer, who is a consumer
The buyer consumer has the right in line with § 53 par. 7 of the Civil Code, to withdraw from the contract within 1 day from collecting the goods, if such contract was concluded via long distance communication. Should the customer decide to utilize this right, the withdrawal must be delivered to the seller latest within 14 days from collecting the goods and that without stating a reason and without any sanction.
The buyer consumer is obliged to return the goods in full, with complete documentation, undamaged, clean, including original packing, in condition and value under which it was collected. Should the goods be returned incomplete or damaged, the seller may decrease the refunded amount by a corresponding amount (in line with § 458 par. 1 of the Civil Code). The money for refunded goods will be returned to the buyer consumer within 30 days from the date withdrawal from the contract.
Besides cases, when the withdrawal from the contract is explicitly given, the consumer may not withdraw from the contract for:

a) delivery of goods or services, the price of which is depending on fluctuations of the market independently of seller’s will,
b) delivery of goods adjusted according to wishes of the consumer or for his person, as well as goods which spoils quickly, wears and tears and outdates quickly (food, tobacco products and other things limited by the law),
c) delivery of newspapers, periodicals and magazines
d) delivery of audio and video recording, if the consumer damaged the original packing.
If the buyer decides to withdraw within the given period, we recommend, in order to speed up the withdrawal, to deliver the goods to seller’s address together with a cover letter stating the possible reason for the withdrawal (not mandatory), with the number for the purchase list and account number or statement that the amount shall be collected in cash or offset against the next purchase.
The buyer acknowledges that if the buyer provides with the goods advertisement items of souvenirs, the seller is obliged to return these advertising items and souvenirs as well.
When fulfilling all the above mentioned conditions needed for refund, the buyer receives a credit, which will, upon his request, sent to a given account and that latest within 30 days from withdrawal from the contract. If failing to state the account number the amount will be, within the same period, automatically prepared for drawing during next purchase or to be collected in cash against providing an original credit note or collecting cash based on providing an original credit note, which is sent to the client without a delay after settling the withdrawal from the contract.
Withdrawal from the contract by the buyer, who is a businessman
In case that the buyer is a businessman, the above mentioned provisions of Art. VI of General commercial conditions apply.

VII. Payment conditions
The Seller accepts the following payment conditions:
a) payment through international payment system PayPal prior to delivery of goods. Goods remain the property of the seller until full payment.

VIII. Delivery conditions
Sending by delivery service — The Czech Post. Goods may send to the buyer by the delivery service of the Czech Post. The price of delivery is subject to price list valid on the order date.

IX. Warranty conditions
Warranty conditions on goods are subject to claims rules of the seller and valid legal regulations of the Czech Republic. The purchase document serves as warranty document.

X. Final provisions
These general commercial conditions are valid and effective until February 1st, 2011 and cancel preceding GCC. The seller reserves the right to change the GCC without prior notification.
